§ 14-16. Municipal court clerk established; duties.

  • (a)

    The city clerk shall designate one (1) or more subordinate employees as a municipal court clerk and such assistants as are deemed necessary. The municipal court clerk shall assist the judge in recording the proceedings of the court and in preparing writs, processes and other papers. A municipal court clerk shall administer oaths required in proceedings before the court, and shall enter all pleadings, processes, and proceedings in the dockets of the court, performing such other clerical duties relating to the proceedings of the court as the judge and/or department director shall direct.

    (b)

    The city manager shall designate one or more employees of the police department as a municipal court marshal and such assistants as are deemed necessary as a part of the municipal court division. The municipal court marshal shall report directly to and shall assist the municipal judge in maintaining order in the courtroom; shall execute writs, warrants, and other processes directed to the marshal as provided by law; shall be responsible for the delivery of prisoners to and from the municipal jail, and the performance of such other duties relating to the proceedings of the court as the judge and/or department director shall prescribe. The court marshal shall be a commissioned peace officer of the city.
